The offences contained in the Criminal Offences App have been amended in line with the Sentencing Council’s recent changes.
The changes affect fraud offences to give more recognition to the impact on victims even when there is no or very little financial loss, and amendments to fly-tipping and other environmental offences to give greater emphasis to community orders over fines.
Guidelines for manslaughter offences have been amended by the introduction of references to coercive or controlling behaviour and include a new aggravating factor of the use of strangulation, suffocation, or asphyxiation.
When an offender was a sole or primary carer, an element for sentencing pregnant offenders was included as a mitigating factor. As a further change, the Sentencing Council made pregnancy, childbirth, and post-natal care new mitigating factors in most offence-specific sentencing guidelines.
The changes come into effect on 1 April 2024.
