In good news for those with pre-settled EU status, the Home Office in compliance with the decision in Independent Monitoring Authority v Secretary of State for the Home Department [2022] EWHC 3274 (Admin), has announced that an additional application to switch from pre-settled to settled status is not required.
From 1 September, migrants with pre-settled status will have their status automatically extended for two years, every two years. Some may find themselves automatically upgraded to settled status without taking any additional steps, but this will likely be random and rare.
Settled status is needed to apply for UK citizenship. This will serve as a prompt for many to make the free online application.
